A federal judge declined Wednesday to suppress the publication of a U.S. Chemical Safety Board report on the 2007 deadly Cabin Creek Hydro Plant accident in Georgetown.

In August, Xcel Energy and contractor RPI Coating Inc. were indicted on criminal charges of violating worker safety and health rules that led to the deaths of five workers.

The companies asked Chief U.S. District Judge Wiley Y. Daniel to stop the release of the report until the end of a trial. The CSB report is in a draft form and may not be ready for a final public release for another six weeks.
