GREELELY, Colo.—The attorney for a former Greeley police officer accused of sexual assault has withdrawn his request to seal the police affidavit in the case.

Weld District Judge Timothy Kerns said during a hearing Thursday that the case against Daniel Shepherd didn’t appear to warrant sealing the court records. The Greeley Tribune reports Kerns lifted a previous order that temporarily sealed them.

The 28-year-old Shepherd is charged with sexual assault and unlawful sexual conduct. An arrest affidavit obtained by the Tribune before the records were sealed says a woman accused the officer of ordering her out of her car and touching her during a March 13 traffic stop.

A preliminary hearing is scheduled June 30.

The Tribune reports city officials won’t say if Shepherd quit the police force or was fired.
