The case against a doctor accused of illegally prescribing painkillers won’t be heard for another 90 days as his attorney combs through mounds of medical files to help him fight more than 50 criminal charges.
Dr. Kevin Clemmer appeared in U.S. District Court on Friday for a hearing on the status of his criminal case.
He has pleaded not guilty.
During the brief hearing, Clemmer’s attorney, Mitchell Baker, said he is still reviewing thousands of medical files from Clemmer’s office and a few hundred more that were seized by prosecutors.
He said some of the handwriting is hard to read and Clemmer needs to assist him in deciphering some of the information in the files.
While there was no announcement of a plea agreement in the works, Baker did tell the judge he was discussing facets of the case with prosecutors to see whether a resolution could be made or whether the case needs to go to trial.
Complaints against Clemmer began in 2009 when an anonymous caller told law enforcement the doctor was selling pills to people illegally, court records show.
By the summer of 2010, DEA agents went undercover inside Clemmer’s Wheat Ridge clinic, and one agent posed as a patient who was seeking painkillers.
The undercover agent scored a prescription for oxycodone after Clemmer coached him on how to fill out a complaint of pain on his medical records, according to an affidavit.
Clemmer is due back in court Aug. 10 for another update on his case.
