DENVER—A lawyer says a judge has rejected the government’s request to dismiss a lawsuit that alleges mentally ill inmates in the Supermax prison in Florence are housed in inhumane conditions.

The U.S. attorney’s office had said the lawsuit against the U.S. Bureau of Prisons and individual officials should be dismissed and that the plaintiffs didn’t show deliberate indifference by any prison official.

Edwin Aro is a lawyer for the inmates. He tells The Denver Post ( ) that U.S. District Judge Richard Matsch (maych) denied the dismissal request and decided Tuesday the case could proceed. Aro says both sides are meeting with Matsch next month for an informal conference to narrow the lawsuit’s focus.

A spokesman for the U.S. Attorney’s Office in Denver said he couldn’t comment on the pending litigation.
