An advocacy group for disabled Coloradans wants Dave & Buster’s to lower the bar.
The Colorado Cross-Disability Coalition sued the Dallas-based restaurant chain Tuesday, claiming that the bar areas of its two Denver-area locations are not accessible to people in wheelchairs.
“They need to lower a portion of the bar or put in lower tables and chairs,” said coalition legal director Kevin Williams.
The barroom is the only place in each restaurant to watch sporting events and should be accessible to all, he said.
The suit, filed in federal court in Denver, also claims the restaurants in Denver and Westminster lack adequate parking for people with disabilities. The suit says the restaurants violate the Americans With Disabilities Act and the Colorado Anti-Discrimination Act.
A representative for Dallas-based Dave & Buster’s did not return a call for comment.
Williams said company officials did not respond to an Aug. 25 letter from the coalition alerting them to the problems and giving them three weeks to respond.
The letter demanded that Dave & Buster’s pay $2,500 to cover the coalition’s legal costs, which Williams said is far less than the cost of litigation. The coalition usually waives the fee when companies respond quickly, he said.
The suit seeks an injunction requiring Dave & Buster’s to bring its restaurants into compliance with the ADA and unspecified money damages.
In March, the coalition secured a record $16.25 million settlement against Kmart in an agreement that forces the retailer to improve access at 1,400 stores nationwide.
