The first question to be asked is whether you can remain business partners
after the dust settles.

In fact, nearly a third of all divorcing business
partners remain business partners after the divorce, at least for a time.

While that choice to continue in business together after the divorce should
be made only with great caution, there are many considerations that favor
continuing the business partnership, post-decree.

Examples of these
considerations are:

When one partner leaves the family business, the departing partner must
usually find a new source of income, which takes time.

When the skills of both partners are necessary to the business, there will
be transition costs to finding and training suitable replacement
talent – and the replacement talent may lack an owner s commitment to the
business. The business may go through several hires to find the right
person.

Skills developed in the family owned business may be discounted in the eyes
of prospective employers. The departing partner may go through several jobs
before finding a “fit,” and may never again earn at the level experienced in
the business.
