DENVER – U.S. Magistrate Judge Craig Shaffer has denied a motion by former Qwest accountant James Kozlowski to require the Securities and Exchange Commission to produce additional evidence related to its fraud lawsuit against Kozlowski and several other former Qwest employees.
The SEC alleges in its suit, filed in March 2005, that the former Qwest officials fraudulently boosted revenues by $3 billion from 1999 to 2002. Qwest later restated much of that revenue.
Also named in the suit are former chief executive Joe Nacchio, former accountant Frank Noyes and former chief financial officers Robert Woodruff and Robin Szeliga, who has reached a preliminary settlement.
