New-home protections

Lawmakers introduced a bill Thursday aimed at protecting homeowners who move into a new home, only to find construction defects down the road.

Called the Homeowner Protection Act of 2007, the bill prohibits home owners from waiving or limiting legal rights, remedies or damages already protected by the Colorado Consumer Protection Act or state statutes.

It comes in response to a number of Colorado homebuilders whose contracts require that buyers waive many of their legal remedies to construction defects, according to the Colorado Home Alliance, a homeowner-advocacy group.

LLC campaign donations

Rep. Gwyn Green has filed a bill to crack down on campaign contributions by limited liability corporations.

The measure would close a loophole exposed during last year’s elections when a number of donors used LLCs to get around the state’s contribution limits for individuals.

Republican gubernatorial candidate Bob Beauprez’s campaign received 32 separate $500 contributions on the same day from 16 LLCs at the same address.

And Democratic candidate Bill Ritter reported maximum contributions from two LLCs while also getting money from their principals.

The Golden Democrat’s bill would prohibit donations to candidates, small-donor committees and political parties if one or more of the members of the LLC is a corporation, a labor organization, a lobbyist or foreign citizen or government.

DUI-test options

Police would have the flexibility to administer different tests to suspected drunken drivers under a bill given initial backing Thursday by the state Senate. SB 154 is a response to a Supreme Court ruling earlier this year, which threw out breath-test evidence against a man when officers were unable to give him a blood test as he requested.
