A Fort Collins judge is considering a request for a new trial for a convicted murderer who claims prosecutorial misconduct.

If Timothy Masters, who was convicted in 1999 of the 1987 murder of Peggy Lee Hettrick, gets a new trial, the prosecution will be handled by lawyers from Adams County.

Masters is serving a life sentence. He claims police have evidence showing that another man, Richard Hammond, fit the profile of Hettrick’s killer. Hammond committed suicide in 1995 shortly after being arrested for illegally videotaping girls and women who sat on a toilet seat in his house.

Masters claims prosecutors destroyed crucial D-N-A evidence.
