Prosecutors have dismissed a trespassing charge against a former state senator accused of moving back into his home after he was evicted.

The bank that owned the home of Democrat Robert Hernandez did not want to press charges, Denver district attorney’s office spokeswoman Lynn Kimbrough said Tuesday.

Hernandez was evicted Feb. 16. Hernandez contended the eviction was due to a refinancing glitch, and he was arrested while retrieving his property.
