CENTENNIAL, Colo.-

Prosecutors said Tuesday they will not seek the death penalty against Parish Carter, who faces murder charges in the deaths of two people, one of whom was expected to testify in a murder trial.

Arapahoe County district attorney’s spokeswoman Kathleen Walsh said Carter’s case does not meet the criteria for the death penalty. She did not elaborate, citing a gag order.

Prosecutors said they would formally tell the judge of their decision at a hearing Wednesday.

Carter and two other men were indicted in March 2006 in the deaths of Javad Marshall-Fields, 23, and his fiance, Vivian Wolfe, 22, who were shot to death in June 2005 as they sat in a car at an intersection in the Denver suburb of Aurora.

Also charged in their deaths are Robert Keith Ray and Sir Mario Owens. Prosecutors have said they will seek the death penalty for them.

Marshall-Fields, a Colorado State University student, was expected to testify in the trials of Ray and Owens in connection with an unrelated 2004 slaying.
