A motions hearing for reputed gang leader Brian Hicks was postponed Thursday because federal authorities did not get the defendant to Denver District Court.

Hicks, 28, faces attempted- murder charges in Denver District Court in connection with shots fired at Kalonniann Clark in 2005, and Hicks’ attorney, Harvey Steinberg, has a motion to dismiss the case because Clark was later killed and can’t testify.

The prosecutor said there is enough evidence on taped jailhouse conversations to continue with the case.

He also brought up some other tapes of witnesses that he wanted the judge to review to determine whether they should be turned over to the defense.

Steinberg argued that the defense should determine if they are relevant.

Hicks is scheduled to go to trial Sept. 10.

Hicks, believed to be the leader of the Tre Tre Crips, is in federal custody on drug charges.

Jeff Dorschner, spokesman for the U.S. attorney’s office, referred the issue to the Denver district attorney’s office.
