Angel Montoya, held last month in the death of 3-year-old Neveah Gallegos but released, is back in police custody.

Denver Police Detective John White announced tonight that Montoya was arrested Wednesday for failing to register as a sex offender.

Montoya, 22, was arrested with assistance from Wheat Ridge Police at the Interstate Inn at 4890 Kipling. White said Montoya was arrested without incident.

Police had issued a warrant for Montoya’s arrest last week, saying that he had failed to notify authorities that he had changed his residential address, which is required of a registered sex offender.

According to Denver police, Montoya was the boyfriend of Neveah’s mother, Miriam Gallegos. Neveah disappeared on Sept. 21, and Montoya was arrested shortly afterward.

The mother was arrested on suspicion of false reporting, fatal child abuse and being an accessory to murder after the child’s body was found on Sept. 24 in a ravine in Lakewood Gulch Park.

The couple was released Oct. 1 without charges. Prosecutors said they were waiting for autopsy reports before deciding how to proceed and which charges to pursue.
