The Securities and Exchange Commission has filed a motion in U.S. District Court to dismiss securities-fraud claims against Randy Cook, former chief of North America operations for Greeley-based United Agri-Products.
Last year, the SEC charged Cook and co-defendants James Charles Blue and Victor Campbell with accounting fraud that allegedly caused UAP’s former parent company, ConAgra, to overstate its income and release misleading financial statements in 1999 and 2000. Blue and Campbell both settled, with Blue opting to pay a fine of $110,000, while Campbell agreed to pay $50,000.
Under the motion filed Friday, Cook would pay a fine of $35,000.
