The U.S. 10th Circuit Court of Appeals today changed the scheduled date for oral arguments in its review of former Qwest chief executive Joe Nacchio’s insider trading conviction.
Oral arguments are now scheduled for Sept. 25 at 1 p.m. at the appeals court in Denver. The hearing had previously been scheduled for Sept. 24.
On Wednesday, the court granted the government’s request for an “en banc” review in which all 12 active judges rehear the case. Nine judges will review the Nacchio case, as three are not participating for undisclosed reasons.
A three-judge panel in March tossed Nacchio’s conviction on 19 counts of insider trading, saying the trial judge wrongly excluded testimony from a defense witness.
Nacchio was convicted in April 2007 and sentenced to six years in prison. He is free on $2 million bond.
