The expert testimony of a defense witness — prohibited during the insider-trading trial of Joe Nacchio — became the “heart of Nacchio’s defense” only on appeal and in hindsight, the government said in a filing Monday in the appellate review of the former Qwest CEO’s conviction.
The 10th Circuit Court of Appeals is reviewing whether the trial judge wrongfully excluded the testimony.
