DENVER—City attorneys asked a federal judge to dismiss a lawsuit filed by five people who say they were mistakenly jailed for an average of nine days.
A lawsuit filed in August by the American Civil Liberties Union of Colorado alleges that Denver officers ignored facts that showed they had the wrong person and that the defendants weren’t promptly brought before a judge so they could explain.
City attorneys on Friday denied wrongdoing and say the plaintiffs’ claims were not the result of official policy. The city’s response states that the plaintiffs have not made a claim that deprives them of a constitutional right. Without elaborating, the response said if the five did suffer damages, it would be the result of actions or omissions of third parties over which police have no control.
