The Denver law firm of Silverman & Olivas has sued Avanza Supermarkets on behalf of three customers, claiming the company misled them and other consumers by charging at checkout 10 percent more than its advertised prices.

The firm filed two suits against Avanza — one in Denver District Court and one in Adams County District Court — on behalf of Rosa Payan, Guadalupe Arroyo and Debra Gomez. The suits seek at least $500 for each customer, and Silverman & Olivas is seeking other Avanza customers.

Avanza owner Nash Finch Co. issued this statement: “Nash Finch has not been served with the complaints and is unaware of their specific allegations, but any suggestion that our advertising is misleading or that our Avanza customers are confused is simply wrong.

“Shelf-Plus pricing is well accepted by our customers because they know we offer value and low prices on products they demand.”
