AURORA — An Arapahoe County judge has granted a woman’s petition to seek prosecution in her 8-year-old sexual assault complaint about a former University of Colorado football player.

The woman, whose name is being withheld because of the nature of her complaint, claims she was sexually assaulted after a May 2000 graduation party by then-CU football recruit Clyde Surrell.

The woman went before Judge Carlos Samour Jr. on Monday to say that a decision by 18th Judicial District Attorney Carol Chambers to not pursue her case was wrong. Samour granted her petition Monday and said he will appoint a special prosecutor to investigate and decide if charges are warranted.

A spokesperson for Chambers told 9News in February 2007 that prosecutors believed they could not win the case.

Surrell first told investigators he didn’t have sexual relations with the woman. However, he eventually admitted to having consensual sex with her after he was informed he matched DNA found on the woman. 9News
