DENVER—A lawyer says Coloradans who alleged Avanza Supermarkets had deceptive signs and pricing policies are proceeding with their lawsuits, even though the signs are gone.

Minneapolis-based Nash Finch Co., which runs Avanza, has denied the claims.

The lawsuits alleged Avanza advertised sales, but then added a 10 percent surcharge at checkout while providing misleading information about the surcharge.

The Colorado Department of Agriculture said last week that it investigated, and Avanza has replaced signs that could be misleading. The department also said one Avanza store that was fined $100 for failing a price-accuracy test has passed a follow-up test.

Plaintiffs’ attorney Craig Silverman says the lawsuits will nevertheless continue.
