DENVER—Former Qwest CEO Joseph Nacchio is asking a judge to dismiss Securities and Exchange Commission claims against him, or at least allow him to use classified information in his defense.

The SEC alleges that actions of Nacchio and other former Qwest Communications International Inc. executives allowed the Denver-based company to improperly report revenue.

The defendants say classified information on Qwest’s government contracts would help their defense but that the government is invoking state secrets privileges, preventing them from using the information.

Nacchio’s lawyers said in court documents filed Tuesday that government lawyers have asked a deposition witness about classified information, so Nacchio should have the same opportunity.
