SALT LAKE CITY—A federal appeals court has upheld a nearly five-year prison term for a Washington County man whose wife used one of his guns to kill herself.

The Denver-based 10th U.S. Circuit Court of Appeals ruled Tuesday that a district court wasn’t wrong to decide that Nicole Cottam-Montgomery’s September 2003 suicide was the result of Robert William Montgomery’s unlawful possession of firearms, which was illegal because he had previously been convicted of felonies.

U.S. District Judge Ted Stewart had taken the suicide into consideration during sentencing, which increased the recommended sentence range under federal guidelines.

Montgomery got time off for good behavior and completed his prison term about a year ago.
