The Colorado State Patrol is re-evaluating a $22 jaywalking ticket it wrote to a 58-year-old bus driver who was hit by a truck as he was helping two elderly passengers cross the street last week.
Jim Moffett, a Regional Transportation District bus driver for 23 years, was the only person hit about 9 p.m. Feb. 20 at Federal Boulevard and West 63rd Avenue.
Moffett is recovering from his injuries, but extensive media coverage has portrayed him as a hero and a gentleman for helping his older passengers.
Another pedestrian still in the crosswalk at the time of the accident, whose name was not immediately available Thursday night, also was cited for jaywalking.
The driver of the truck, Steven David, 48, of Denver, was issued a ticket for careless driving causing bodily injury.
All of the charges are under review, which is not unusual, said Sgt. John Hahn of the Colorado State Patrol.
“An accident investigation is a pretty complicated matter,” he said. “A trooper has a variety of circumstances he has to consider when he goes out to an accident scene.
“Until a case has gone through the system, until it’s been adjudicated, it’s not truly closed.”
Troopers previously have said that despite Moffett’s good intentions, his jaywalking contributed to the accident.
Hahn said the Adams County district attorney’s office also is evaluating whether charges, if any, are necessary.
Moffett’s family could not immediately be reached for comment.
