A jaywalking citation issued to a bus driver who was seriously injured while saving two pedestrians from an oncoming pickup has been dismissed.
Also dismissed was a jaywalking citation issued to one of the two pedestrians who bus driver Jim Moffett pushed to safety.
State Patrol Lt. Col. Doyle S. Eicher, commander of the patrol’s northern region, said today that after considering the total circumstances, and consulting with Adams County prosecutors, the citations against Moffett and the pedestrian, Eddie Moore, 55, were withdrawn.
However, a ticket issued to Steven David, the driver of the pickup, will stand, the state patrol said.
On Feb. 20, Moffett, 58, a 23-year RTD veteran, was escorting Moore, 78-year-old Patricia Denning, and Denning’s adult daughter across Federal at the intersection of Federal Boulevard and West 63rd Avenue.
State Patrol Sgt. John Hahn said there are no painted crosswalks at the intersection and no traffic controls regulate traffic on Federal Boulevard.
Hahn said the group had crossed almost all the lanes of traffic. They were in the final lane – the left turn lane – on the far side of the street from where the bus was parked when Moffett was hit.
Hahn said the ticket against David was not dismissed because he swerved around a stopped vehicle and into the left lane, where Moffett was hit.
The speed limit on Federal at the point of the accident is 45 mph, said Hahn.
Eicher said a review of what occurred was appropriate in the case.
“Recognizing the complexities that a trooper faces when investigating a crash, there are circumstances when taking time to do a further review of all the facts and details is appropriate,” said Eicher.
