DENVER—A federal appellate court in Denver has upheld the arrest and drug plea of a man stopped in Kansas because an Ohio State Buckeyes bracket obscured his license plate.

Antonio Orduna-Martinez pleaded guilty in May 2006 to possession of more than 50 pounds of cocaine with intent to distribute. A lower court denied a request to suppress evidence based on what Orduna-Martinez said was an improper traffic stop on Interstate 70.

He was sentenced to nearly four years in prison.

In its ruling Friday, a three-judge panel of the 10th U.S. Circuit Court of Appeals sided with the Kansas trooper, saying the case “presents an unforeseen cost of perhaps vicarious alma mater loyalty.”
