COLORADO SPRINGS, Colo.—Prosecutors have dismissed a fine against the general manager of a Cripple Creek casino, now that the establishment has decided to drop its exemption claim from the state smoking ban.
Bronco Billy’s court challenge had been scheduled to begin Tuesday, but was dropped after prosecutors agreed to dismiss the fine against general manager Marc Murphy.
Bronco Billy’s became the first Cripple Creek casino to claim the smoking ban’s cigar bar exemption and allow smoking in June 2008. Other casinos claimed the exemption as well, but were ticketed after officials from a nonsmoking casino complained.
The casinos then stopped allowing smoking in October when a Teller County judge said one of them did not meet the proper criteria for an exemption.
