Qwest has filed a motion to dismiss a complaint from the town of Silverton and San Juan County that they have been unfairly left out of a decade-old state project to link all county seats with fiber optics.

Silverton is in the only one of Colorado’s 64 county seats that did not get a fiber-optic link under the state’s $37 million contract with Qwest that expires in less than a year.

In the dismissal motion filed with the Colorado Public Utilities Commission, Qwest said the complaint has no legal merit and that the PUC lacks jurisdiction on the issue.
