Boulder County District Attorney Stan Garnett said today that a sheriff’s deputy was justified in shooting Cosmo “Daniel” Moshe Grill on June 5.

Grill had taken a Taser from another officer when Deputy Lanie Delong, 31, fired the shot in the early-morning fracas at Grill’s home at 863 Cherryvale Road in Boulder.

“From the beginning to the end of this event, the fight was on with an uncooperative and assaultive suspect,” Garnett said in his decision.

Grill, who had recently moved to Boulder from New York City, had been screaming and had thrown a rock through his neighbor’s window earlier, according to investigators.

He was expected to agree to a plea deal in Boulder County District Court earlier this month but instead was checked into a New York hospital after suffering a psychotic episode, the Boulder Daily Camera reported.
