DENVER—Adams County has won a four-year legal battle over a low-level radioactive site permitted by the state.
The Colorado Supreme Court says the county can challenge the state’s award of a permit to a Massachusetts company to dispose of the waste about 70 miles east of Denver. The county’s lawsuit over the permit for the Clean Harbors Deer Trail Facility will be heard in state district court.
Lower courts ruled that Adams County didn’t have the legal right to challenge the state permit. The state Supreme Court voted 5-2 in the county’s favor.
Adams County sued when state regulators in 2005 gave Clean Harbors Environmental Services Inc. a radioactive-materials license and hazardous-waste permit without first obtaining permission from the County.
