ENGLEWOOD, Colo.—A judge accepted a plea deal calling for a man to serve 3 years in prison for the beating death of a man during an argument despite objections from the victim’s family.

Forty-one-year-old Leonard Ross pleaded guilty to negligent homicide in the March 2009 death of 35-year-old Timothy Sanchez. Along with prison, Ross was ordered Friday to pay $4,200 restitution.

Prosecutors say evidence showed Sanchez had a blood alcohol level of 0.294, more than triple the drunk driving limit, and had a history of violence when drunk. In accepting the deal, District Judge Marilyn Antrim said there was a chance that Ross would be acquitted.

Della Soliz, Sanchez’s mother, told Denver station KMGH-TV that prosecutors should have taken the chance. She said: “there’s no justice, none at all.”
