NIWOT, Colo.—Church and government groups have filed friend-of-the-court briefs in a battle between Boulder County and a Niwot church that wants to expand.

At issue is whether the county commissioners violated the federal Religious Land Use and Institutionalized Persons Act when it denied the church a permit for an addition.

Commissioners say the expansion wasn’t in harmony with the surrounding area, didn’t comply with the county’s comprehensive plan and was an over-intensive use of the land.

The church won a lawsuit in federal court. The county has appealed.

Groups filing briefs include three Roman Catholic archdioceses, two Episcopal dioceses, the American Jewish Congress, the American Planning Association, Colorado Counties Inc. and the Colorado Municipal League.
