A man accused of threatening to kill a Boulder doctor who performs abortions has reached a plea agreement with prosecutors that could keep him out of jail, 9News has learned.
Donald Hertz, 70, of Spokane, Wash., has told a judge he wants to plead guilty to federal charges when he makes his scheduled appearance Monday in U.S. District Court in Denver. He is charged with interstate threats and violating the Freedom of Access to Clinic Entrances act.
Dr. Warren Hern told 9News his staff received a call June 23, 2009, from an unknown man. The caller said two Vietnam veterans were on their way from Spanish Fork, Utah, to kill Hern’s family.
If a judge accepts the plea deal, Hertz could receive probation. 9News
