
Developer Erik Osborn’s second trial started Monday in Denver District Court and is expected to continue all week.
A Denver grand jury indicted Osborn, 42, in October, charging him with one count of theft over $20,000 in connection with a downtown condo project.
The indictment alleges that Osborn diverted money from a development project at 1800 Glenarm Place controlled by capital-funds manager Mi chelle Brokaw.
If convicted, Osborn could face up to 12 years in prison.
Earlier this month, Osborn was sentenced to 10 years in community corrections on two felony theft convictions after a jury in December found him guilty of stealing money from investors in a high-profile downtown condo project and a Greenwood Village office- building renovation.
In that case, prosecutors said Osborn illegally diverted $147,000 from funds intended for the One Lincoln Park residential development at East 20th Avenue and Lincoln Street, and $108,000 from an office project at 5351 S. Roslyn St.
Investors included auto dealer Doug Moreland; radio talk-show host Tom Manoogian, whose on-air moniker is “Lou from Littleton”; and private-equity investment-fund manager Blair Richardson.
