A judge ruled Wednesday afternoon that convicted animal abuser Abby Toll will serve out her time in jail, the Daily Camera reported, denying a motion by her attorney to grant the 21-year-old former University of Colorado student a sentence delay.

Joshua Maximon, Toll’s attorney, filed a motion for an appeal bond and a stay of execution of Toll’s 30-day jail and three-year probation sentence for binding and taping an 8-month-old shiba inu to a refrigerator in Boulder last year.

Boulder District Judge Maria Berkenkotter said Toll’s chances of winning on appeal were low and there was not sufficient reason to delay her sentence.
