DENVER—A 73-year-old real estate developer from Chicago is behind bars in Colorado, accused of hiring a hit man to kill a business associate.

The U.S. Attorney’s office says Brooks Kellogg paid $2,000 to an undercover agent he thought was a hit man at Denver International Airport on Tuesday. Kellogg allegedly asked him to kill Stephen Bunyard of Destin, Fla.

According to court documents, Bunyard had been involved in a real estate deal with Kellogg and sued him, winning one judgement for over $2.5 million.

Kellogg is due to appear in federal court Monday for a detention hearing. He faces up to 10 years in prison if convicted.

His attorney, Larry Pozner, didn’t return a telephone call seeking comment.
