EAGLE, Colo.—A Colorado prosecutor is defending his decision not to seek more serious charges against a financial manager accused of seriously injuring a cyclist in a hit-and-run accident.

Eagle County District Attorney Mark Hurlbert has offered Martin Erzinger the chance to plead guilty to two misdemeanors. He says it’s the best deal possible given that Erzinger has no criminal record.

Hurlbert told the Vail Daily that the victim, New York doctor Steven Milo, wanted Erzinger to plead guilty to a felony with a deferred judgment, which would have allowed the plea to eventually drop off his record.

He says Erzinger has also said he’d be willing to pay a “significant amount” of restitution.

Hurlbert has gotten over 1,000 e-mails since his decision was announced last week.
