The city of Boulder is suing a couple on accusations that they built a structure to divert water from a ditch and took water from the waterway, without permission, for their own personal use.
Despite letters from city attorneys ordering the couple to stop taking the city’s water and to remove the diversion structure, according to the lawsuit, Clarence and Eleanor Kneebone have said they intend to continue taking from the ditch, which the city uses to irrigate open space.
The Kneebones — who have a small-acreage ranch at 3795 75th St. in Boulder County — also have expressed intentions to lease some of the water that they divert from the ditch to others, according to the lawsuit, showing a “complete disregard for the city’s rights.”
Clarence Kneebone, 78, told the Camera on Thursday that some of the city’s allegations are false and that he and his wife acquired shares in 2008 that allow them access to the ditch.
