A Castle Rock medical marijuana dispensary forced to shut down Tuesday filed civil action against the town in hopes of reopening it.
Rob Corry, lawyer for Plants 4 Life, filed a preliminary injunction and temporary restraining order in Douglas County District Court late Tuesday afternoon.
Castle Rock’s town council had approved an ordinance banning dispensaries. The owners of Plants 4 Life, the town’s only dispensary, fought the ordinance by collecting enough signatures to force a townwide vote on the issue.
On April 5, voters upheld the ordinance.
“We’re arguing there is a constitutional right for medical marijuana,” Corry said.
Now it will be decided in court. A hearing is set for April 22.
