GRAND JUNCTION, Colo.—The Colorado Court of Appeals upheld unemployment benefits for a Mesa County jailer dismissed for alleged incompetence.
In its ruling last week involving a former booking technician, the court rejected county arguments that the former employee was “at fault” for separation from the county. The sheriff’s department employee worked at the jail from November 2009 and May 2010 and was dismissed after written warnings about poor job performance.
Grand Junction’s The Daily Sentinel reports that the court upheld a Colorado Industrial Claim Appeals office ruling that benefits should be awarded because the employee lacked the skills for the job in the first place.
Previous experience of the employee included working in services such as day care and sign-language interpretation.
