GREELEY, Colo.—State wildlife officials have found one egg in nests abandoned by great blue herons along the Cache la Poudre River (cash-luh-POO’-der) after an irrigation company started using heavy machinery below them.
But U.S. Fish and Wildlife Service Congressional Liaison Matt Kales said Wednesday there’s not enough evidence that any migratory bird protection laws were violated.
Two weeks ago, work on an irrigation canal was halted after about 30 birds that were nesting in trees left. Wildlife officials wanted to see if the construction work caused the birds to abandon active nests.
Colorado Division of Wildlife spokeswoman Jennifer Churchill tells the Greeley Tribune that when investigators got to the scene, there wasn’t enough evidence to warrant any fines.
The city was told the work can resume.
