DENVER—The Colorado Supreme Court has refused to hear a challenge to Boulder’s camping ordinance after a Boulder homeless man claimed the city’s camping ordinance is unconstitutional.

David Madison was convicted of camping without a permit after police found him sleeping in a sleeping bag in 2009.

According to the Boulder Daily Camera (), the ruling means Boulder police can continue to ticket people for sleeping in public places overnight.

Madison and his attorneys argued that Boulder’s ordinance punishes people for being homeless.

Attorneys for Boulder said the city’s rules aren’t targeted at a specific class of people, but at public camping.
