DENVER—A judge is affirming an order by Colorado regulators for Cotter Corp. to pump out and treat uranium-tainted water at its defunct Schwartzwalder Mine in Jefferson County.
The Colorado Mined Land Reclamation Board issued its order in August 2010 after concluding Cotter violated the Colorado Mined Land Reclamation Act.
Denver District Court Judge Robert Hyatt said in his ruling Friday that there was enough evidence to support the board’s decisions.
The mine has received state scrutiny. Earlier this week, state water quality officials said uranium-laden water from the mine is still flowing into Ralston Creek. They ordered the company to divert creek water away from its facility and find the source of contamination. Cotter has until Oct. 7 to submit a design and construction plan for a bypass pipeline.
