A second bank wants to depose bankrupt troubleshooter Tom Martino over allegations he fraudulently transferred assets to his wife, Holly, before filing bankruptcy last month, according to court papers.
First-Citizens Bank & Trust has asked the U.S. Bankruptcy Court in Denver to allow it to sit in on an examination of the Martinos by International Bank, which says the television and radio consumer advocate is hiding millions in assets. Martino has denied the allegation.
First-Citizens in July was awarded a $3.7 million judgment in El Paso County against Martino and a real estate development group to which he belongs and is seeking to collect. Bankruptcy Judge Michael Romero granted International’s deposition request Thursday and, barring delays, it should occur within three weeks.
