Trinchera Ranch owner Louis Bacon has filed an appeal of the Public Utility Commission’s decision to grant Xcel and Tri-State permission to build a transmission line over La Veta Pass.
The proposed 136-mile power line would cross a portion of Bacon’s southern Colorado ranch.
In filing the appeal, Trinchera Ranch alleged numerous violations of due process, egregious violations, and speculative evidence. It is asking Costilla County District Court to reverse the decision recently made by the PUC.
The PUC upheld its previous approval of the project Sept. 2. At the time, Bacon indicated his intent to file suit.
Bacon claims that the high-voltage line is unnecessary, costly to Colorado ratepayers and would harm undeveloped portions of his 172,000- acre ranch in Costilla County, bordering La Veta Pass.
