Prosecutors will not get to have their own mental-health expert examine Stephanie Rochester — a Superior woman who has pleaded not guilty by reason of insanity in the death of her 6-month-old son — and they will not get to review previous evaluations done by the two doctors who already found Rochester to be legally insane.
The ruling Monday by Boulder District Judge Thomas Mulvahill represents a setback for prosecutors, who had questioned findings by the other doctors, one of whom works for the defense team and the other of whom works for the state mental-health hospital in Pueblo.
Rochester is charged with first-degree murder and child abuse resulting in death.
