COLORADO SPRINGS, Colo.—Prosecutors say an El Paso County sheriff’s deputy was justified in shooting and killing a woman outside a motel after the woman moved her car toward a deputy.

The Gazette reports ( ) the 4th Judicial District Attorney’s office will not charge Deputy Marcus Miller in the Sept. 13 death of 27-year-old Christen Lea Vargas.

Deputies were at the motel to serve a fugitive warrant on a different person who appeared to be in Vargas’ car. Prosecutors say Miller fired when Vargas moved the car toward him and hit his foot. Another suspect took the wheel and sped away.

Prosecutors say Vargas had an arrest warrant for escape from a community corrections facility.

Vargas’ body was found in the abandoned car three hours later outside a hospital.
