BOULDER, Colo.—A Boulder County mother convicted in her infant son’s death has lost her bid to get a new trial.
The Daily Camera reports ( ) a judge on Monday denied the request by Molly Midyette, who now uses her maiden name, Bowers. She is serving 16 years in prison for not seeking medical help in time to prevent her son’s death in 2006.
Her ex-husband, Alex Midyette, also received a 16-year sentence. Prosecutors had alleged he caused the child’s injuries.
Bowers argued she deserved a new trial because Alex Midyette and his family intimidated her to the point that she couldn’t assist in her defense.
Her trial attorney testified he believed she suffered from battered women’s syndrome, which kept her from telling him the extent of her ex-husband’s control.
