AURORA, Colo.—A cold-case murder case in the 1998 stabbing death of an Aurora woman is stalled for now as prosecutors say they won’t try again to charge Kevin Lewayne McKinney.
McKinney was charged with murder last year after police said DNA evidence linked him to the death of Diane Caldwell, who was found dead in a ditch. McKinney’s trial ended in a mistrial last month after jurors could not agree.
McKinney’s lawyer said McKinney was wearing an ankle monitor that showed he was at his mother’s home when Caldwell was killed. Police argued that the coroner’s estimate of Caldwell’s time of death was inaccurate.
McKinney is currently serving a prison sentence for a 1999 attempted murder in Arapahoe County. The Aurora Sentinel reports he isn’t up for parole until 2016 ().
