GRAND JUNCTION, Colo.—A federal judge has ruled that a search by Colorado state troopers that resulted in a man’s death was illegal.

U.S. District Judge Lewis Babcock ruled Wednesday that troopers violated Jason Kemp’s rights while investigating a traffic accident when they went to his home and kicked in his door. Kemp was unarmed, but a trooper said he saw a flash and thought he had been shot so he fired at Kemp.

According to the Grand Junction Daily Sentinel ( ), Babcock denied a bid by state patrol Sgt. Chad Dunlap to be dismissed from a civil lawsuit filed in connection with Kemp’s death in his Redlands home in July 2010.
