“I have only read the affidavit and complaint, and it seems kind of thin,” said Jumaev’s attorney, Barnaby Wittels.

But Wittels said he still hasn’t seen everything prosecutors have on his client.

Jumaev, an Uzbek national, was in the country on a visitor visa that expired in October 2007, according to Carl Rusnok, a spokesman for Immigration and Customs Enforcement. He was arrested in February 2010 by ICE agents and they obtained his cellphone number, which was then tracked by the FBI. No information was available about why he wasn’t deported.

As for Muhtorov, he has pleaded not guilty to the charges against him and is due back in .
